"Measures to combat organized crime"
ARTICLE 1
Laboratories legality
1. The Region, in order to help promote civic education for students, supports primary schools (fourth and fifth classes) and secondary schools through special purpose funds to the activation of laboratories for study and research the values \u200b\u200bof legality, ethics public and civic education, particularly with regard to compliance with the urban quality and the protection of architectural heritage, artistic and monumental municipalities. These laboratories can also be implemented in a network with the involvement of public and private institutions, associations, foundations. The same can also make use of the oral and written testimonies of persons who have distinguished themselves in the fight against crime and official documents that are particularly significant in the fight against the Mafia. 2. The Regional Councillor for cultural and environmental goods and for public education is authorized to provide, by October 31 of each year to schools that request them, up to five thousand euro for the establishment of laboratories in paragraph 1.

6. Gli oneri discendenti dal comma 5, valutati in 1.000 migliaia di euro per ciascuno degli esercizi finanziari 2009 e 2010, trovano riscontro nel bilancio pluriennale della Regione, UPB 4.2.1.5.2, accantonamento 1001.
ARTICLE 2
One Account for contracts
1. ARTICLE 3
Establishment of free zones for the legality (ZFL)
1. The President of the Region, in consultation with the Minister of the Interior, establishing for each province one or more zones for the legality (ZFL), for a territory with a population of not less than fifty thousand inhabitants. Establishment of free zones for the legality (ZFL)
2. In favor of employers who report or extortion demands from organized crime, involving changes in the normal course of economic activity, which is followed by a request for trial, the State shall, for five tax periods starting on the request, following the reimbursement of taxes due on the basis of the statements made, and charges related to the business:
a) income tax;
b) social security contributions;
c) local property taxes .
3. For social security and local property taxes, as set out respectively in points b) and c) of paragraph 2, shall be refunded the amount due and paid.
4. Entrepreneurs operating in the Region, outside of free zones for the legality, or denouncing extortion demands from organized crime, involving changes in the normal course of economic activity, which is followed by a request for postponement opinion, are eligible for benefits under paragraph 2.
5. Pending or in the event of a negative definition of the procedure under Article 88, paragraphs 2 and 3 of the Treaty establishing the European Community, the provisions of paragraphs 2 and 3 shall apply within the limits laid down for aid de minimis'.
6. The giving of the Law of 23 February 1999, No 44, is exempt, as provided in Article 9, paragraph 3 of the Act, the payment of the regional tax on productive activities.
7. For the purposes of this article is entitled, from the financial year 2009 and for five years, the annual expenditure, for specific purposes, estimated in 100 thousand euro.
8. The charges referred to in paragraph 7, of 100 thousand euro for each of fiscal years 2009 and 2010, are reflected in multi-annual budget of the Region 2008-2010, UPB 4.2.1.5.2, provision 1001.

ARTICLE 5
Revolving Fund
1. For reuse and the use of social goods confiscated from the Mafia and allocated to municipalities under the Law of 31 May 1965, n. 575 and subsequent amendments and additions, although these data managed by associations of municipalities, 15 per cent of the resources from the Fund established under Article 43 of Law March 26, 2002, No 2 and subsequent amendments thereto, is intended for the technical design of the works necessary to adapt such property to productive or social objectives to be pursued. ARTICLE 6
Competition of the Region to pay interest
1. The region contributes to the extent of 50 percent, the payment of interest payable by municipalities for loans for the financing of interventions and the works referred to in Article 5. Competition of the Region to pay interest

ARTICLE 7 Granting of guarantees
1. In order to promote better utilization of assets, social cooperatives, non-profit associations, community recovery, cooperatives of employees of the municipalities are confiscated and sureties granted by the Region to cover up to 75 percent of Operating loans at reduced interest rates and mortgage required by the cooperative for the design and construction of the works of adaptation. 2. 3. In the notices in the measures and funding programs, both regional and community, the region assigned to cooperatives, non-profit associations, community recovery and the common assignees of confiscated property, a specific score for projects that involve reuse social purposes of such goods.
ARTICLE 8
Simplifying procedures

2. Article 18 of Decree of 21 September 2005, no 11, is replaced by the following:

The regional administration is authorized to grant, in the form of guarantees and interest subsidies, de minimis aid for agricultural credit operations, including claims of tenure, and any other credit transaction other than those referred to in Articles 16 and 17, sotto qualsiasi forma tecnica e a prescindere dalla durata del finanziamento, nel rispetto dei limiti e delle condizioni previste dal Regolamento CE n. 1998/2006 per le imprese attive nel settore della trasformazione e commercializzazione dei prodotti agricoli, dal Regolamento CE n. 875/2007 per le imprese attive nel settore della pesca e dal Regolamento CE n. 1535/2007 per le imprese attive nel settore della produzione dei prodotti agricoli.
3. All'articolo 22 della legge regionale 21 settembre 2005, n. 11, è aggiunto il seguente comma:
'3 bis. Al fine di agevolare l'accesso al credito alle società cooperative che gestiscono patrimoni confiscati per reati legati alla criminalità organizzata di stampo mafioso è istituita apposita riserva ammontante a 400 migliaia di euro a valere sulle disponibilità dell'UPB 4.3.2.6.2 (di cui 250 migliaia di euro dal capitolo 616804 e 150 migliaia di euro dal capitolo 616811) del bilancio della Regione, a decorrere dall'esercizio finanziario 2008, da destinare alle società cooperative di cui al presente comma aderenti ai confidi riconosciuti ai sensi della presente legge. La quota delle risorse discendenti dalle residue disponibilità non utilizzate su tale riserva è impiegata per le finalità di cui all'articolo 3, comma 1.'.
ARTICOLO 10
Criteri di precedenza nell'assegnazione in concessione di aree consortili, artigianali or infrastructure

ARTICLE 11
Control Commission
1. Office of solidarity with the victims of crime organized crime and mafia

'Art 7. Office of solidarity with the victims of organized crime and mafia crime - 1. Administrative procedures resulting from the application of this Act are assigned to the office for the solidarity with the victims of organized crime and mafia crime, established in the department of family, social policies and local autonomy of the Regional of the family, and social policies of local governments.
2. The office referred to in paragraph 1 acquires jurisdiction over the claims of the ascertainment of the authenticity complaints and documentation to obtain the same benefits, with particular reference to the fact that the victim does not contest the fact that criminal offenses in connection with this Article 12 of the Code of Criminal Procedure.
3. The office referred to in paragraph 1 expresses also the views held by the applicants of the requirements for recruitment to other public authorities referred to in Article 4.
ARTICLE 14 Prohibition of overlapping benefits
'Art. 8. Divieto di cumulo dei benefici - 1. I benefici economici contemplati dalla presente legge, ove non diversamente stabilito, non sono cumulabili con identiche provvidenze previste da altre pubbliche amministrazioni sulla scorta delle medesime circostanze.
2. I soggetti beneficiari della presente legge, siano essi vittime o familiari, devono essere del tutto estranei ad ambienti criminali e malavitosi.
3. Nel caso in cui la legislazione statale preveda elargizioni di benefici per le medesime fattispecie, l'avente diritto è tenuto a presentare previamente istanza all'amministrazione statale e la Regione può intervenire soltanto a titolo di anticipazione.

ARTICLE 15

1a. In the absence of specific decisions that have identified the perpetrators of the crime, the status of innocent victim of the mafia or organized crime provides the advisory commission established pursuant to Article 11 of Presidential Decree of 28 July 1999, n. 510, as set out in paragraph 1 b.
1b. The Regional President is authorized to enter into a Memorandum of Understanding with the Minister of the Interior that the commission referred to in paragraph 1 to comment on applications submitted to obtain the benefits of this Act. '.
2. In paragraph 2 of Article 20 of Law 13 September 1999, No 20, the words in the period between 1944 and 1960 'are replaced by the period between 1944 and 1966'.
3. ARTICLE 16
Qualifying companies
1. Exclusion from entitlement to benefits
1. The entrepreneur as a result of criminal sentence of conviction by a court and pleaded guilty to the crime under Article 367 of the Penal Code, committed in order to enjoy the benefits granted under any title, including those referred to in Article 3 paragraph 2, letters a), b) and c) of this Act, is excluded per cinque anni dall'accesso a qualunque forma di beneficio, non solo di carattere economico, previsto dalla Regione o da altro ente pubblico regionale o locale.
